You may use the Art Happy website to explore exhibitions and artwork, learn about artists, purchase artwork, apply for exhibitions, participate in our affiliate programme, access information about Art Happy and use other services we make available.
You agree to use the website lawfully and in accordance with these Terms.

These Website Terms govern general use of the Art Happy website.
Other terms may apply depending on how you interact with Art Happy, including our:
Collector Terms of Sale when purchasing artwork;
Artist Exhibition Terms when applying for or participating in an exhibition;
Affiliate Terms when participating in the Art Happy affiliate programme;

Where specific terms apply to a transaction or activity, those specific terms take precedence over these Website Terms in relation to that transaction or activity.
4. Information on the website
We take reasonable care to ensure information published on the Art Happy website is accurate and useful.
However, website content is provided primarily for general information and may change.
Exhibition dates, availability, artwork details, prices and other information may be updated from time to time.
If we discover an error affecting a purchase, application or other transaction, we will deal with it in accordance with the terms applying to that transaction and applicable law.
5. Artwork and artist information
Art Happy exhibitions feature work by independent artists.
Artwork images, descriptions, biographies and other information may be supplied by the participating artist.
Artists are responsible for providing accurate information about themselves and their artwork in accordance with the Artist Exhibition Terms.
Art Happy may edit, format or present supplied information for use on the website and in exhibition marketing.
Colours and appearance may vary between screens and devices. Digital images cannot guarantee an exact representation of the physical artwork.
6. Artwork availability
Original artworks are unique and availability may change.
Displaying an artwork on the website does not guarantee that it will remain available for purchase.
The rules governing artwork purchases, order acceptance and what happens if an artwork becomes unavailable are set out in our Collector Terms of Sale.
7. Intellectual property belonging to Art Happy
Unless otherwise stated, the Art Happy website and the content created by Art Happy — including our branding, logo, website design, written content, graphics and promotional materials — belong to or are licensed to Art Happy and are protected by intellectual property law.
You may view and use the website for your own lawful personal or business purposes connected with Art Happy.
You must not reproduce, sell, licence, commercially exploit or substantially copy Art Happy content without our permission, except where permitted by law or under another agreement with us.
8. Artist copyright and artwork images
Artists retain the copyright and other intellectual property rights in their artwork unless those rights have been separately transferred.
Purchasing an original artwork does not automatically transfer copyright in that artwork to the collector.
Artwork images displayed on Art Happy may not be copied, reproduced, commercially exploited, used to create derivative products or represented as your own without the appropriate permission.
Art Happy's use of artist images and materials is governed by our arrangements with participating artists.
9. Affiliate and promotional materials
Approved Art Happy affiliates may be given permission to use certain Art Happy promotional materials and artwork images for the purpose of promoting Art Happy.
That permission is governed by our Affiliate Terms and does not give affiliates ownership of Art Happy or artist intellectual property.
10. Acceptable use
You must not use the Art Happy website:
unlawfully or fraudulently;
to interfere with the operation or security of the website;
to introduce viruses, malicious software or other harmful material;
to attempt to gain unauthorised access to the website, its systems or data;
to scrape, harvest or systematically extract website content or personal information without permission;
to impersonate another person, artist, affiliate or Art Happy;
to submit knowingly false or misleading information;
to infringe intellectual property, privacy or other legal rights; or
in any way that could reasonably damage Art Happy, participating artists, collectors or other users.
We may restrict access to the website or relevant services where we reasonably believe these requirements have been breached.
11. Links to other websites
The Art Happy website may contain links to websites or services operated by other organisations.
These links may be provided for convenience or because those services are used in connection with Art Happy.
We do not control independent third-party websites and are not responsible for their content, availability or practices.
You should review the applicable terms and privacy information when using third-party services.

We aim to keep Art Happy available and working properly, but we cannot guarantee uninterrupted or error-free access.
We may temporarily suspend, restrict or change parts of the website for maintenance, security, technical reasons or to develop the Art Happy service.
