Collector Terms of Sale

These terms apply when you purchase artwork through Art Happy.

Art Happy brings independent artists and collectors together through curated online exhibitions. We want the experience of buying original art to be enjoyable, straightforward and transparent, so these terms explain how purchases, delivery, cancellations, returns and refunds work.

1. Who you are buying from

The artwork offered through Art Happy is sold by the individual artist whose work you are purchasing.

Art Happy acts as the artist's selling agent. We provide the exhibition platform, present and market the artwork, operate the online checkout and administer the sale on the artist's behalf.

Art Happy collects your payment on the artist's behalf.

Once your artwork has been purchased, we will provide the artist with the information needed to arrange delivery. The artist will then contact you directly and will be responsible for packaging, dispatch, delivery arrangements, tracking information and communication with you about the delivery.

If you wish to cancel your purchase, return an artwork, request a refund or raise an issue that cannot be resolved directly with the artist, you should contact Art Happy. We will support the process and work with the artist where necessary.

The artist's identity will be made available to you as part of the transaction.

3. The artwork

Every artwork sold through Art Happy is an original work of art.

Artwork listings will include photographs and information supplied by the artist, together with presentation images or videos that may be created by Art Happy.

We make reasonable efforts to present artwork accurately. However, colours can appear differently on different screens and devices, and room-setting images or mock-ups are intended to help you visualise the artwork and may not represent exact scale or colour.

Please read the individual artwork listing carefully before purchasing.

4. Artwork sizes and frames

Artwork dimensions shown on Art Happy refer to the artwork itself and exclude any frame.

Artists may choose to offer an artwork framed at no additional cost to the collector. Where a frame is included in the sale, this will be clearly stated in the individual artwork listing.

Any frame supplied forms part of the purchased artwork but does not affect the artwork's selling price.

5. Prices

The price displayed on the artwork listing is the price you pay for the artwork.

Artwork prices are based on the Art Happy artwork format and dimensions and do not increase where an artist chooses to include a frame.

Where a frame is included, this will be clearly stated in the artwork listing, and there will be no additional charge for it.

Any applicable taxes will be dealt with in accordance with the artist's tax status and relevant law.

UK delivery is included in the artwork price.

For delivery outside the UK, an additional international delivery charge will apply where shown at checkout.

6. Placing an order

When you place an order through Art Happy, you are offering to purchase the artwork from the artist.

You must provide complete and accurate contact, payment and delivery information.

Once your purchase has been successfully processed, you will receive confirmation by email.

Art Happy may contact you if there is a problem with your order or if further information is required to administer the transaction.

7. Artwork availability

All artwork offered through Art Happy is original and therefore unique.

Artists are required to keep artwork entered into an Art Happy exhibition available for sale during the relevant period.

Very occasionally, an artwork may become unavailable before our systems have been updated. If this happens after you place an order, Art Happy will contact you and refund any payment you have made.

8. Payment

Payment is made through the payment methods available at checkout.

Art Happy collects payment on behalf of the artist and administers the financial transaction.

Your order is not complete until payment has been successfully authorised.

9. UK delivery

Delivery to UK addresses is included in the artwork price.

The artist is responsible for safely packaging the artwork and arranging appropriate tracked delivery directly to you.

Artists are normally required to dispatch sold artwork within 3 working days of being notified of the sale.

The artist will communicate directly with you about dispatch and delivery and will provide tracking or other relevant delivery information where available.

Any questions about the progress of your delivery should be raised directly with the artist.

10. International delivery

Art Happy may make artwork available for delivery outside the UK.

Where international delivery is available, the applicable delivery charge will be shown at checkout.

The artist is responsible for packaging the artwork, arranging international delivery and communicating directly with you about dispatch and delivery.

You are responsible for any import duties, local taxes, customs charges or handling fees imposed in the destination country unless expressly stated otherwise.

International delivery times may vary because of customs clearance and other matters outside the artist's or Art Happy's control.

Any questions about the progress of your delivery should be raised directly with the artist.

11. When your artwork arrives

Please inspect your artwork as soon as reasonably possible after delivery.

If the artwork or packaging appears damaged, please take photographs of both the artwork and the packaging and contact the artist promptly using the contact details provided to you.

The artist arranged the delivery and will work with you to establish what has happened and what action is required.

Please keep the artwork and its original packaging until the issue has been resolved.

If the issue affects your purchase and cannot be resolved directly with the artist, please contact Art Happy and we will work with both parties to help resolve the transaction.

12. Your right to cancel

If you are purchasing as a consumer online, you will normally have the legal right to change your mind.

You may notify Art Happy that you wish to cancel your purchase within 14 days of receiving the artwork, without giving a reason.

Once you have notified us that you wish to cancel, you normally have a further 14 days to return the artwork.

These rights are subject to applicable consumer law and any lawful exceptions.

13. How to cancel

To cancel your purchase, contact Art Happy using the contact details provided on our website and clearly tell us that you wish to cancel.

Please include your name, order details and the artwork purchased so that we can identify your order.

We will confirm your cancellation and provide you with the information needed to arrange the return of the artwork to the artist.

14. Returning an artwork

Unless the artwork is faulty, damaged or not as described, you will normally be responsible for the cost of returning it.

Once you have notified Art Happy that you wish to cancel your purchase, the artist will contact you directly to provide the return address and any information reasonably required for the return.

The artwork must be packaged carefully and returned using an appropriate tracked and insured delivery service.

Where reasonably possible, we recommend using the original packaging.

You are responsible for taking reasonable care of the artwork while it is in your possession.

Please retain proof of return and tracking information until the return and any associated refund have been completed.

15. Refunds following cancellation

Where you exercise your legal right to cancel, the appropriate refund will be made in accordance with your statutory rights.

We may wait until the artwork has been returned, or until you provide evidence that it has been sent back, where the law allows us to do so.

Refunds will normally be made using the original payment method.

Refunds will be made within the timescales required by applicable consumer law.

16. Damaged, faulty or misdescribed artwork

Your statutory rights are not affected by these terms.

If an artwork appears to have been damaged during delivery, please contact the artist first. The artist arranged the delivery and is responsible for dealing with the delivery provider where necessary.

If the artwork is faulty, materially different from its description, or you believe you are entitled to a refund or other remedy, please contact Art Happy.

We may ask you to provide photographs or other information about the artwork and will work with you and the artist to determine the appropriate next steps.

Where you have a legal right to a refund or other remedy, this will be dealt with in accordance with your statutory rights.

17. Delivery problems

The artist is responsible for arranging delivery of your artwork and will provide you with relevant delivery information.

If your artwork is delayed, does not arrive, appears to have been lost in transit, or there is another delivery issue, please contact the artist directly in the first instance.

As the person who arranged the delivery, the artist is responsible for contacting the delivery provider and investigating delivery problems.

If a delivery problem cannot be resolved and affects the completion of your purchase, please contact Art Happy. We will then work with you and the artist to determine what needs to happen with the transaction.

18. Ownership and risk

Ownership of the physical artwork transfers in accordance with the sale between you and the artist.

Nothing in your purchase transfers the artist's copyright or other intellectual property rights in the artwork to you.

Purchasing an original artwork does not give you the right to reproduce, commercially exploit or create copies of the artwork unless the artist separately agrees to this.

19. Artist copyright

The artist retains copyright and other intellectual property rights in their artwork where applicable.

Art Happy and the artist may continue to use photographs or images of sold artwork for portfolios, exhibition archives, publicity, social media and promotional purposes.

20. Personal information

We use personal information to administer your purchase, process payment, enable the artist to fulfil your order, deal with cancellations, returns or refunds and meet our legal obligations.

Information necessary to fulfil your purchase, including your name, delivery address and relevant contact details, will be shared with the artist.

The artist may share information necessary for delivery with their chosen delivery provider for the purpose of delivering your artwork.

21. Communications

Art Happy may contact you about your order using the email address or other contact information you provide.

Following a purchase, the artist may contact you directly regarding packaging, dispatch, tracking and delivery of your artwork.

Please make sure the information supplied at checkout is accurate and check your messages following a purchase.

22. Events outside reasonable control

Neither Art Happy nor the artist will be responsible for delays caused by circumstances genuinely outside reasonable control, although this does not affect any statutory rights you may have.

23. Third-party services

Art Happy uses third-party services including payment processors and website providers.

Artists may use third-party delivery providers to fulfil artwork purchases.

Those services may be subject to their own terms and privacy policies.

Nothing in this section limits rights you have under applicable consumer law.

24. Our role

Art Happy facilitates and administers sales between independent artists and collectors.

The artist is the seller of the artwork and remains responsible for the artwork, its packaging, dispatch and delivery to the collector.

Art Happy provides the exhibition platform, marketing, online checkout and administration of the sale and collects payment on the artist's behalf.

Art Happy does not own, hold, package or dispatch the artwork and does not arrange its delivery.

Once a sale has been completed, the artist is responsible for communicating directly with the collector about fulfilment and delivery.

Art Happy remains responsible for administering matters relating to the transaction itself, including payments, cancellations, returns and refunds, and may become involved where an issue between the artist and collector cannot otherwise be resolved.

25. Changes to these terms

We may update these terms from time to time.

The terms applying to your purchase will normally be those in force when your order was placed, except where a change is required by law or expressly agreed with you.

26. Your statutory rights

Nothing in these terms excludes, restricts or replaces any rights or remedies that you have under applicable consumer law.

If any provision of these terms conflicts with a statutory consumer right that cannot legally be excluded, the statutory right will apply.

27. Governing law

These terms are governed by Scottish law.

Nothing in these terms prevents a consumer from relying on any mandatory protections or jurisdiction rights available to them under applicable consumer law.
