Art Happy respects your privacy and is committed to protecting your personal information.

This Privacy Policy explains how we collect, use, store and share personal information when you visit the Art Happy website, apply for or participate in an exhibition, purchase artwork, join our affiliate programme, sign up for updates or Early Access, contact us or otherwise interact with Art Happy.

This Privacy Policy applies to personal information we process about people including:

visitors to the Art Happy website;
collectors and prospective collectors;
artists and artist applicants;
Art Happy affiliates and prospective affiliates;
people who sign up for Early Access, exhibition announcements or other marketing;
people who attend Art Happy training or business coaching;
people who contact us with an enquiry; and
other individuals who interact with Art Happy.

3. Information we may collect

The information we collect depends on how you interact with Art Happy.

It may include:

Identity information, such as your name, artist name, business or organisation name, date of birth and other identification information where required.

Contact information, such as your email address, telephone number, postal address, delivery address and billing address.

Artist information, such as your artist biography, artwork information, photographs, application information, exhibition history, sales information and information necessary to administer your participation in Art Happy.

Artwork and transaction information, including artwork purchased or sold, prices, payments, commissions, marketing payments, delivery information, cancellations, returns and refunds.

Affiliate information, including your marketing link, referrals attributed to your link, qualifying sales, marketing payments and related account information.

Payment information, such as information necessary to collect or make payments. Payment card information may be processed by our payment provider rather than stored directly by Art Happy.

Tax and regulatory information, where required, including VAT registration information, tax identification information, date of birth, address, business details, payment information and other information we may be legally required to collect or verify in relation to artists or sellers.

Marketing information, including whether you have subscribed to Art Happy emails, Early Access or other communications and your marketing preferences.

Communications, including emails, enquiries, application information and other correspondence between you and Art Happy.

Technical and website information, which may include IP address, browser and device information, pages visited, website interactions, cookie information and similar technical data.

4. How we collect your information

We may collect personal information:

directly from you when you complete a form;
when you apply for an exhibition;
when you are selected for or participate in an exhibition;
when you purchase artwork;
when you join or participate in our affiliate programme;
when you subscribe to emails or Early Access;
when you contact us;
when you attend Art Happy training or business coaching;
when you use an Art Happy marketing or affiliate link;
automatically when you use our website, where permitted;
through our website, payment, email, affiliate or other service providers; and
from artists, collectors or other people where this is reasonably necessary to administer an Art Happy transaction.

We may use personal information to:

operate and maintain the Art Happy website;
receive and assess artist applications;
curate and administer exhibitions;
create artist and artwork listings;
process artwork purchases;
administer payments to and from artists;
connect collectors with the artist responsible for fulfilling their order;
arrange and administer cancellations, returns and refunds;
administer our affiliate programme;
track qualifying affiliate referrals and calculate marketing payments;
provide marketing training and business coaching;
communicate with artists, collectors and affiliates;
provide Early Access to exhibitions;
send marketing communications where permitted;
respond to enquiries;
prevent fraud and misuse;
keep appropriate financial and business records;
comply with tax, accounting, regulatory and legal requirements;
comply with digital-platform seller reporting obligations where applicable;
establish, exercise or defend legal claims;
understand and improve the Art Happy website and exhibitions; and
protect Art Happy, our users and our business.

6. Our lawful bases for using personal information

UK data protection law requires us to have a lawful basis for processing personal information.

Depending on the circumstances, we may rely on:

Contract — where processing is necessary to enter into or perform a contract with you. This includes administering exhibition participation, artwork purchases, artist sales and affiliate arrangements.

Legal obligation — where we need to process information to comply with tax, accounting, digital-platform reporting, consumer protection or other legal requirements.

Legitimate interests — where processing is reasonably necessary for the operation, administration, security and development of Art Happy and those interests are not overridden by your rights and interests.

Consent — where you have actively agreed to particular processing, including certain electronic marketing or non-essential cookies where consent is required.

Where we rely on consent, you can withdraw that consent at any time.

7. Artist and seller information

If you apply for or participate in an Art Happy exhibition, we collect information necessary to assess your application, present your work, administer your participation and process sales.

Where your artwork sells, we also keep information about the transaction, amounts paid, Art Happy commission, marketing payments and other relevant transaction information.

Art Happy may also be required to collect and verify additional information about sellers under UK digital-platform reporting rules.

Depending on the applicable requirements, this may include information such as your legal name, address, date of birth, tax identification information, VAT information, business information, payment information and information about transactions conducted through Art Happy.

Where required by law, relevant information may be reported to HM Revenue & Customs or another competent tax authority.

HMRC currently requires reporting platform operators to collect and verify specified seller information and report relevant seller and transaction information.

8. Collector information shared with artists

When you purchase artwork through Art Happy, the artwork is supplied by the independent artist who created and sells it.

Art Happy may therefore provide that artist with the personal information reasonably necessary to fulfil your order.

This may include your:

name;
delivery address;
email address;
telephone number where reasonably required for delivery; and
relevant order and delivery information.

The artist may use this information to package, dispatch and deliver your artwork, provide tracking information, communicate with you about delivery and deal with practical delivery or return arrangements.

Participating artists are required to use collector information only for purposes connected with the Art Happy transaction and legitimate legal or accounting requirements.

They must not add collectors to their own marketing lists without appropriate permission.

9. Affiliate tracking

Art Happy uses GoAffPro to operate its affiliate programme and track qualifying referrals and sales.

When you follow an Art Happy affiliate or marketing link, GoAffPro may record information about the referral so that Art Happy can determine whether a subsequent qualifying purchase should be attributed to the relevant artist or affiliate.

Art Happy's standard affiliate referral tracking period is 30 days. A qualifying purchase made during that period may be attributed to the relevant affiliate in accordance with our Affiliate Terms. An affiliate's marketing link may remain active for as long as they remain an approved Art Happy affiliate; the 30-day period applies to each individual referral, not to the life of the affiliate's marketing link.

10. Marketing and Early Access

You may choose to receive Art Happy news, exhibition announcements, Early Access invitations and other marketing communications.

Where consent is required for electronic marketing, we will ask for it appropriately.

You can unsubscribe from marketing emails at any time using the unsubscribe option in the message or by contacting us.

Unsubscribing from marketing does not prevent us from sending necessary service or transactional communications relating to an application, purchase, exhibition, sale, affiliate relationship or other transaction with us.

Current ICO guidance generally requires consent before marketing emails are sent to individuals, subject to limited exceptions such as the existing-customer soft opt-in.

11. Cookies and similar technologies

Art Happy uses cookies and similar technologies for purposes that may include:

operating the website;
remembering preferences;
website security;
understanding website usage;
analytics;
affiliate referral tracking; and
marketing where applicable.

Some cookies are necessary for the website to function.

Other cookies or tracking technologies may require your consent before they are used.

12. Who we share information with

We do not sell your personal information.

We may share personal information where reasonably necessary with:

artists fulfilling collector orders;
website hosting and e-commerce providers;
payment processors;
email and communications providers;
GoAffPro, which we currently use to operate our affiliate programme and provide referral and sales tracking;
analytics and technology providers;
delivery providers where appropriate;
professional advisers such as accountants, lawyers and tax advisers;
HM Revenue & Customs and other tax or regulatory authorities where required;
law enforcement, courts or other authorities where legally required; and
other service providers reasonably necessary to operate Art Happy.

We only share information that is reasonably necessary for the relevant purpose.

13. Payments

Payments made through Art Happy may be processed using third-party payment providers.

Those providers may collect and process payment information directly in accordance with their own privacy policies and legal obligations.

Art Happy does not need to receive or retain your complete payment card details where these are handled directly by the payment provider.

14. International transfers

Some organisations that provide technology, website, payment, email, analytics or other services to Art Happy may process personal information outside the United Kingdom.

Where personal information is transferred internationally, we take reasonable steps to ensure that an appropriate legal mechanism or safeguard is in place where required by UK data protection law.

15. How long we keep information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including legal, accounting, tax, reporting, fraud-prevention and dispute-resolution requirements.

Different information may therefore be retained for different periods.

For example:

unsuccessful application information may be deleted or anonymised when it is no longer reasonably required;
exhibition and transaction records may be retained for accounting, tax and legal purposes;
affiliate records may be retained while the affiliate relationship continues and afterwards where necessary for accounting, tax or legal purposes;
marketing information may be retained until you unsubscribe or otherwise withdraw your consent, although we may retain limited suppression information to ensure we respect your request;
correspondence may be retained where reasonably necessary to deal with an enquiry, transaction or dispute; and
information required for statutory digital-platform reporting may be retained for the period required by law.

HMRC currently requires digital-platform operators subject to the reporting rules to retain relevant reporting and due-diligence records for five years after the end of the relevant reportable period.

16. Keeping information secure

We take reasonable organisational and technical measures to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

Where personal information is shared with an artist to fulfil an order, artists are also required to keep collector information secure and use it only for permitted purposes.

No internet-based service can guarantee absolute security, but we take reasonable steps appropriate to the nature of the information we process.

17. Your data protection rights

Depending on the circumstances, UK data protection law may give you rights including the right to:

ask for access to personal information we hold about you;
ask us to correct inaccurate or incomplete information;
ask us to erase your personal information in certain circumstances;
ask us to restrict how your information is used in certain circumstances;
object to certain processing;
receive certain information in a portable format;
withdraw consent where processing is based on consent; and
object to direct marketing at any time.

These rights are not absolute and may be subject to legal exceptions.

Art Happy exhibitions and affiliate participation are intended for people aged 18 or over.

The website and artwork shop are not specifically directed at children and we do not knowingly seek to collect personal information from children for artist or affiliate participation.

The Art Happy website may contain links to websites operated by other organisations.

We are not responsible for the privacy practices of independent third-party websites. You should review their privacy information when visiting them.

21. Changes to this Privacy Policy

We may update this Privacy Policy as Art Happy develops or where legal, regulatory or operational requirements change.

The current version will be published on the Art Happy website and will show the date it was last updated.

Where a change materially affects how we use personal information, we will take reasonable steps to bring the change to the attention of affected people where appropriate.
